The Biden Administration has taken steps to control and enforce the laws on illegal, Chinese-made disposable vapes in kid-friendly flavors. This includes issuing a Red Alert allowing for the seizure of these products at ports of entry and sending warning letters to Elf Bar, Breeze Smoke and other foreign vape manufacturers, as well as issuing letters of enforcement and fines against non-compliant distributors and retailers. But lax enforcement is hampering efforts to get these products off our shelves.
As the FDA and White House mull a ban on menthol cigarettes, smoking rates are at an all time low, while unaccountable Chinese vape manufacturers take advantage of lax enforcement to flood store shelves with these illegal, kid-enticing products. The administration needs to focus on the real problem.
The Biden administration has even recognized that “the science clearly shows that a majority of youth who use e-cigarettes report that the products they are using are disposable and flavored.”
Acknowledging that “enforcement action” against these harmful products is now a priority is certainly a step in the right direction. However, mere recognition is not enough. We need the FDA to see this through to the end and eliminate these dangerous products from our communities.
The FDA needs to strengthen their enforcement policies regarding Chinese-made disposable vapes. Despite being rightly recognized as a priority for compliance and enforcement action, these manufacturers continue to elude customs and deliver a steady stream of these illegal products to store shelves.
The recent actions taken by the FDA and the Biden administration against these foreign manufacturers were promising first steps. However, we know now that words alone won’t suffice. We need the FDA and the Biden administration to go the distance and fully protect American youth from the dangers posed by illegal Chinese-made disposable vapes, especially those in flavors intended to entice kids.
